{"id":7085,"date":"2025-06-01T00:04:40","date_gmt":"2025-06-01T00:04:40","guid":{"rendered":"https:\/\/africanamericanvoice.net\/?p=7085"},"modified":"2025-05-27T23:51:31","modified_gmt":"2025-05-27T23:51:31","slug":"no-jail-time-for-man-who-hurled-racist-homophobic-statements-at-interracial-family","status":"publish","type":"post","link":"https:\/\/africanamericanvoice.net\/?p=7085","title":{"rendered":"No Jail Time for Man Who Hurled Racist, Homophobic Statements at Interracial Family"},"content":{"rendered":"<div class=\"tdb-block-inner td-fix-index\">\n<div class=\"tdb-author-name-wrap\"><span class=\"tdb-author-by\">By<\/span> <a class=\"tdb-author-name\" href=\"https:\/\/americancommunitymedia.org\/author\/sunita\/\">Sunita Sohrabji<\/a><\/div>\n<\/div>\n<div><\/div>\n<div>\n<div class=\"tdb-block-inner td-fix-index\">\n<p>A South Lake Tahoe man, who yelled racist and homophobic slurs at his interracial neighbors, will not serve jail time.<\/p>\n<p>In <a href=\"https:\/\/americancommunitymedia.org\/stop-the-hate\/south-lake-tahoe-man-hurls-racist-slurs-at-neighbors\/\">home security video footage<\/a> captured last fall, Mark Douglas \u2014 former neighbor of Norman Randy Pratt and his wife Kimyoeuth, who is Cambodian American \u2014 was seen repeatedly shouting: \u201cYou\u2019re a f*****g pussy;\u201d \u201cF*****g g***s;\u201d and \u201clittle f****t.\u201d<\/p>\n<p>Douglas continued to repeat the slurs, then escalated into death threats. \u201cI wouldn\u2019t go to sleep. I\u2019ll be coming to see you. I am going to take care of you just like I did with the rest of the f*****g g***s,\u201d he yelled, as shown on video footage. He then walked over and kicked Randy Pratt twice.<\/p>\n<h2 id=\"h-no-hate-crime-charge\" class=\"wp-block-heading\">No Hate Crime Charge<\/h2>\n<p>The Pratts had asked the El Dorado County District Attorney\u2019s Office to charge Douglas with a hate crime. But Douglas was charged only with criminal threat and battery, both misdemeanor offenses.<\/p>\n<p>Douglas was scheduled to appear in court May 2 to accept the terms of a plea deal. El Dorado County Assistant District Attorney Lisette Suder told American Community Media that Douglas\u2019 attorney appeared for him and entered the change of plea in absentia.<\/p>\n<p>Douglas was sentenced to 30 days county jail. But, as he now lives out of state, he will be permitted to serve an alternative sentence through community service, explained Suder. This equates to 112 hours of community service (30 days minus the one day he served in custody). Proof of completion of this community service must be provided by Sept. 19.<\/p>\n<p>The perpetrator must also remain 100 yards away from the Pratts for the next 3 years, according to Suder. Douglas is not allowed to possess weapons, and must also complete an anger management class by Aug. 1, said Suder.<\/p>\n<h2 id=\"h-damaging-impact-on-children\" class=\"wp-block-heading\">Damaging Impact on Children<\/h2>\n<p>Kimyoeuth Pratt filed a victim\u2019s impact statement with the court, saying her young children, ages 7 and 9, were deeply impacted by the incident. \u201cThe multiple threats\u00a0over a 45 minute period\u00a0Mark Douglas yelled at our family on August 3, 2024 while\u00a0he stood and paced in front of our home\u00a0left very damaging and lasting impacts upon myself and my two young children,\u201d wrote Pratt in the statement forwarded to ACoM.<\/p>\n<p>She noted that she was born\u00a0in a\u00a0refugee camp as her family struggled to\u00a0escape\u00a0Cambodia during the <a href=\"https:\/\/cla.umn.edu\/chgs\/holocaust-genocide-education\/resource-guides\/cambodia\">Khmer Rouge genocide<\/a>.<\/p>\n<p>\u201dWhile my family successfully escaped one of the greatest genocides in humanity I wish I could tell my children that hate\u00a0based violence\u00a0has consequences\u00a0here in El Dorado County.\u201d<\/p>\n<p>\u201dThe Asian hate Mark Douglas\u00a0demonstrated and\u00a0targeted\u00a0upon\u00a0myself and\u00a0my\u00a0children\u00a0\u2014absent of any type of charge for his actions against us\u00a0\u2014 has\u00a0damaged\u00a0our\u00a0sense of security,\u00a0safety\u00a0and the belief in the righteousness of justice,\u201d wrote Pratt.<\/p>\n<h2 id=\"h-justice-not-served\" class=\"wp-block-heading\">Justice Not Served<\/h2>\n<p>\u201cI feel very disappointed that \u2014 in this case \u2014 justice has not been served to all of those affected by the crime Mark Douglas committed,\u201d she wrote.<\/p>\n<p>Randy Pratt also expressed his disappointment that no additional charges would be filed against Douglas, despite evidence indicating the incident was motivated by hate.<\/p>\n<p>Marita Etcuba\u00f1ez, Vice President of Strategic Initiatives at Asian Americans Advancing Justice\/AAJC told ACoM in an earlier interview that though the incident may rise to the level of a hate crime, prosecutors usually choose to go after what\u2019s easiest to prove.<\/p>\n<p>In 2023 \u2014 the last year for which data is available \u2014 \u00a01,970 hate crimes were reported by law enforcement agencies in California. 679 hate crime cases were sent to prosecutors that year, but only 5 went to trial. In an interview last April, California Attorney General Rob Bonta told ACoM that hate crimes are notoriously difficult to prosecute. \u201cThey require a proof of intent.
