If passed, it would amend California\u2019s foreclosure process to ensure homeowners keep their equity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to housing rights experts,&nbsp;<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220SB1323\">SB 1323<\/a>\u2019s passage could keep billions in California\u2019s low-income communities of color.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhat we see is an increase in black homeownership\u2026 and black neighborhoods are appreciating at the same rate as white neighborhoods,\u201d says Sil Vossler, a consumer protection attorney who specializes in foreclosure cases and who authored the language in the bill.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAt the same time,\u201d he adds, \u201cthere\u2019s been a decrease in black wealth relative to white people. So, what we\u2019re seeing is basically the disparity between black people and white people to realize their housing gains.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A major reason for this, according to Vossler, has to do with the foreclosure process, where distressed homes are put up for auction by lenders at below-market rates.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Between 2017 and 2020, there were 65,000 foreclosures in California, a majority of them impacting elderly homeowners and people of color, according to Francis Wong, a postdoctoral fellow with the National Bureau of Economic Research.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Together with researchers from UC Berkeley, Wong authored a recent study that found on average foreclosed properties sold at a&nbsp;<a href=\"https:\/\/www.nber.org\/papers\/w29306\">22 percent discount below their market value<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cRelative to white homeowners, the annual unlevered returns realized by black homeowners living in the same county are 3.7 percentage points lower, while those realized by Hispanic homeowners are 2.0 percentage points lower,\u201d the study notes.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/secureservercdn.net\/50.62.88.172\/99t.7da.myftpupload.com\/wp-content\/uploads\/2022\/04\/foreclosure_graphs.jpg\"><img decoding=\"async\" src=\"https:\/\/secureservercdn.net\/50.62.88.172\/99t.7da.myftpupload.com\/wp-content\/uploads\/2022\/04\/foreclosure_graphs-1024x483.jpg\" alt=\"\" class=\"wp-image-13548\"\/><\/a><figcaption>These figures present rates of financial distress, measured by loan delinquency, as a function of homeowner<br>race\/ethnicity and the current loan-to-value ratio. (Source:\u00a0<a href=\"https:\/\/www.nber.org\/papers\/w29306\" target=\"_blank\" rel=\"noreferrer noopener\">Racial Disparities in Housing Returns<\/a>)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The result is an estimated net loss of roughly $115,000 per homeowner for each of the 65,000 foreclosed homes or roughly $7.5 billion in lost accrued generational wealth, says Vossler. Nationally, the figure balloons to more than $67.7 billion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCommunities are losing so much wealth through this process that it is actually a driving cause of the racial wealth gap,\u201d he notes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And that gap could widen further as foreclosure rates begin to tick up nationally, with a&nbsp;<a href=\"https:\/\/www.marketwatch.com\/picks\/foreclosures-have-jumped-70-heres-what-that-says-about-the-housing-market-01647301411\">seven-fold increase<\/a>&nbsp;between December of 2020 and January of this year, and a&nbsp;<a href=\"https:\/\/www.attomdata.com\/news\/market-trends\/foreclosures\/attom-q1-2022-u-s-foreclosure-market-report\/\">40 percent increase<\/a>&nbsp;in the first quarter of this year compared to the previous quarter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SB 1323 was introduced by Senator Bob Archuleta (D-Pico Rivera), whose office released a statement noting, \u201cCalifornia\u2019s foreclosure process obscures and legitimizes the large-scale extraction of billions of dollars of wealth from low-income communities.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The \u201closs of even a single dollar of this equity,\u201d the statement continued, \u201cis irreplaceable, putting the consumer at increased risk of poverty and homelessness.\u201d It called current foreclosure procedures \u201cinhumane.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under existing law, lenders \u2013 eager to recoup their loans as quickly as possible \u2013 are not required to list repossessed homes on the market, instead of putting the properties up for auction, where cash-rich investors purchase the homes for prices far below their market value. As lenders are only able to recover the remaining balance on the loan, bidding typically starts there, regardless of the actual value of the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The result often means catastrophic losses for homeowners who have in many cases spent years paying down their mortgages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vossler points to a recent client in San Francisco \u2013 an elderly immigrant mother on a fixed income with a dependent adult daughter \u2013 who purchased her home in 1994. After 24 years of making regular payments, the mother\u2019s finances took a turn for the worse and she began to miss payments. The home was eventually repossessed and sold by the lender for just over $50,000, resulting in a loss of the mother\u2019s home and some $750,000 in accrued equity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEvery dollar an investor saves in the purchase is a dollar lost by the homeowner,\u201d says Vossler, adding that after the foreclosure crisis of 2010, \u201ceveryone focused on foreclosure prevention. No one looked at how harmful the actual foreclosure process is to the homeowner.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SB 1323 is the first bill in&nbsp;<a href=\"https:\/\/www.jstor.org\/stable\/26601916\">more than 300 years<\/a>&nbsp;\u2014&nbsp;when the practice of selling foreclosed mortgages through auction was first established \u2014&nbsp;that looks to amend the process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If passed it would require lenders to post foreclosed homes on a multiple listing service (MLS), working with realtors to sell the secured property for its appraised value. This would open the sale of the home to anyone with access to financing, as opposed to auctions that are&nbsp;<a href=\"https:\/\/www.mercurynews.com\/2017\/06\/05\/three-east-bay-men-convicted-in-fraud-scheme-to-buy-foreclosed-homes\/\">prone to fraud<\/a>&nbsp;and tend to favor corporate investors with ready cash.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anything over the value of the loan derived from the sale, meanwhile, would go to the homeowner, ensuring they retain their equity.
