Still, her parents forced her into an abusive marriage with a 20-year-old man from Chitungwiza, 30 kilometers [18.6 miles] south of Harare, Zimbabwe\u2019s capital city.<\/p>\n<p>She sought help from a neighbor who introduced her to a local movement that advances the rights of young girls,\u00a0<a href=\"https:\/\/syszim.org.zw\/\">Shamwari YeMwanasikana<\/a>, who facilitated her return to her parents.<\/p>\n<div class=\"code-block code-block-2\">\n<div id=\"taboola-mid-article-thumbnails\">\u201cI dropped out of high school in Form Three when my parents sent me to stay with the man who got me pregnant,\u201d she told Zenger News.<\/div>\n<\/div>\n<p>\u201cIt was a painful experience since I was very young. But in our culture, it\u2019s a disgrace to the family to fall pregnant before marriage. My parents were so frustrated and humiliated that they married me off without considering that I was still a minor.\u201d<\/p>\n<div class=\"code-block code-block-3\">\n<div id=\"div-gpt-ad-1767121-4\">With the financial support of the charity organization, Sobwe went back to school after giving birth to her daughter and later enrolled at <a href=\"http:\/\/www.hrepoly.ac.zw\/\">Harare Polytechnic College<\/a>, where she is currently studying Media and Journalism.<\/div>\n<\/div>\n<p>Not many minors in her situation are as fortunate.<\/p>\n<p>Fourteen-year-old Anna Memory Machaya died on July 15 while giving birth at an indigenous apostolic church shrine in Marange, east of Zimbabwe.<\/p>\n<div class=\"code-block code-block-7\">\n<div id=\"div-gpt-ad-1767121-41\">She was buried just two hours later at the same shrine, her death concealed by her family and the church. She had been married off to a 26-year-old male member of the church, Evans Momberume.<\/div>\n<\/div>\n<p>Machaya\u2019s death attracted national and global attention, and an\u00a0<a href=\"https:\/\/www.change.org\/p\/commissioner-general-zimbabwe-republic-police-policezimbabwe-stop-the-rape-of-children-in-the-name-of-religion-we-want-justiceformemory\">online petition<\/a>\u00a0demanding justice for her has surpassed 94 000 signatures.<\/p>\n<div class=\"code-block code-block-14\">\n<div id=\"div-gpt-ad-1767121-61\">While Zimbabweans were coming to terms with the incident, detectives from the <a href=\"http:\/\/www.zrp.gov.zw\/index.php?option=com_content&amp;view=category&amp;layout=blog&amp;id=45&amp;Itemid=743\">Zimbabwe Republic Police<\/a>\u00a0found that Machaya\u2019s parents had even offered her nine-year-old sister to Momberume as a replacement bride.<\/div>\n<\/div>\n<p>Machaya\u2019s parents and Momberume\u2014who is facing charges of rape and sleeping with a minor\u2014have since been arrested and remanded in custody, awaiting trial.<\/p>\n<p>Zimbabwe has a maternal mortality ratio of 462 deaths per 100,000 live births, according to the World Health Organization\u2019s 2019\u00a0<a href=\"https:\/\/www.afro.who.int\/news\/health-workers-gain-new-knowledge-help-reduce-maternal-and-perinatal-deaths-zimbabwe\">Multiple Indicator Cluster Survey<\/a>.<\/p>\n<p>It also said pregnancy and childbirth complications are the leading cause of death among girls aged 15\u201319 years globally.<\/p>\n<p>In 2020, the World Health Organization\u00a0<a href=\"https:\/\/www.who.int\/news-room\/fact-sheets\/detail\/adolescent-pregnancy\">reported<\/a>\u00a0that adolescent mothers (ages 10-19 years) face higher risks of eclampsia,\u00a0<a href=\"https:\/\/www.msdmanuals.com\/professional\/gynecology-and-obstetrics\/postpartum-care-and-associated-disorders\/puerperal-endometritis\">puerperal endometritis<\/a>, and systemic infections than women aged 20 to 24 years.<\/p>\n<p>Babies of adolescent mothers face higher risks of low birth weight, preterm delivery, and severe neonatal conditions said the report.<\/p>\n<p>A Zimbabwean Constitutional Court\u00a0<a href=\"https:\/\/zimlii.org\/zw\/judgment\/files\/constitutional-court-zimbabwe\/2016\/12\/2015-zwcc-12.pdf\">ruled<\/a>\u00a0in 2016 that child marriages were unconstitutional and set 18 as the minimum age for marriage.<\/p>\n<p>However, delays in realigning the\u00a0<a href=\"file:\/\/\/C:\/Users\/ADMIN\/Downloads\/Constitution-of-Zimbabwe-Amendment_No_20_-_14-05-2013%20(3).pdf\">2013 constitution<\/a>\u00a0with the\u00a0<a href=\"https:\/\/zimlii.org\/zw\/legislation\/act\/1961\/34\">Guardianship of Minors Act,<\/a>\u00a0which gives parents and guardians power to consent to underage marriages, derail the fight against the practice.<\/p>\n<p>Following Machaya\u2019s case, Justice and Parliamentary Affairs Minister Ziyambi Ziyambi urged MPs to speedily pass the\u00a0<a href=\"http:\/\/www.veritaszim.net\/sites\/veritas_d\/files\/Veritas%20Model%20Guardianship%20of%20Minors%20Amendment%20Bill.pdf\">Guardianship of Minors Amendment Bill, 2021,<\/a>\u00a0which seeks to bar parents from consenting to child marriages.<\/p>\n<p>\u201cChild marriages are a topical issue,\u201d Ziyambi told Parliament on Aug. 24.<\/p>\n<p>\u201cWe need to barricade all the avenues of this practice. In the worrisome case of Anna Machaya, it is alleged that the deceased minor\u2019s marriage was consented to by the parents. The Constitution accords the right to find a family only to those who have reached the age of 18.\u201d<\/p>\n<p>The Bill would delete Section 4 (1) (b) of the\u00a0<a href=\"https:\/\/zimlii.org\/zw\/legislation\/act\/1961\/34\">Guardianship of Minors Act<\/a>\u00a0which states that:<\/p>\n<p>\u201cIf it is proved that it would be in the interests of the minor to do so, [the high court can] grant to either parent the sole guardianship, which shall include the power to consent to a marriage\u2026\u201d<\/p>\n<p>Child marriages are prevalent in Zimbabwe, especially among the indigenous apostolic churches that command millions of followers and encourage polygamy.<\/p>\n<p>One in every three girls in Zimbabwe is married before 18 years, according to\u00a0<a href=\"https:\/\/plan-international.org\/because-i-am-a-girl\/out-school-and-marriage\">Plan International<\/a>, a humanitarian organization that advances children\u2019s rights and equality for girls.<\/p>\n<p>\u201cHarmful cultural beliefs and religious practices are the major drivers of child marriages,\u201dRudo Mangwayata, the legal officer for Shamwari YeMwanasikana, told Zenger News.<\/p>\n<p>\u201cWe saw in the Machaya case how much these cultural beliefs impede the growth and development of the girl child and how the places of worship are used for violating young girls in the name of worship.\u201d<\/p>\n<p>But traditional leaders forcefully spoke out against child marriages following Machaya\u2019s death of Machaya, signaling that the tide could be turning against the practice.<\/p>\n<p>\u201cContrary to public perception that local culture perpetuated the practice of elder men marrying child brides, it stood against it,\u201d Munyaradzi Tivaringe, chief nyamaropa [paramount chief] of Nyanga area, eastern Zimbabwe, told Zenger News.<\/p>\n<p>\u201cOur culture always protected young girls from being sexually violated. [Women] elders would frequently check young girls for any signs of violation of their virginity until they were old enough to get married. Therefore, it\u2019s not proper for these criminals to hide behind our culture. We do not condone such practices.\u201d<\/p>\n<p>He called for the constitutional courts to mete out stiffer penalties for perpetrators of child marriages.<\/p>\n<p>\u201cI have similar matters before my court, which we will handle traditionally before handing over the culprits to the police.
